Terms of Service

Next of Kin Plan LLC — Last Updated: February 24, 2026 · Effective Date: February 24, 2026

Next of Kin Plan is an organizational tool for estate readiness. We do not provide legal, financial, tax, medical, or estate planning advice. The Platform helps you organize and store information; it does not create legal documents or replace professional estate planning services.

These Terms of Service (“Terms”) govern your access to and use of the Next of Kin Plan platform (“Service,” “Platform,” “NOKP”) operated by Next of Kin Plan LLC (“we,” “us,” “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Next of Kin Plan provides a secure digital platform for organizing critical family information including financial accounts, property records, medications, professional contacts, legacy messages, and emergency checklists. The Service is designed to help families prepare for crises and life transitions by centralizing important information in one secure, accessible location.

What We Do:

  • Provide secure, encrypted storage for your documents, accounts, and personal information
  • Use AI-assisted scanning to extract data from bill photos and medication labels (see Section 9)
  • Generate a personalized 72-Hour Checklist from your actual data
  • Enable role-based family sharing (spouse, executor, Point Person) with granular access controls
  • Deliver legacy messages (text, audio, video) to designated recipients on dates or events you specify
  • Send bill reminders, tax deadline alerts, and re-engagement nudges
  • Provide PDF export of your complete plan

What We Do NOT Do:

  • Create legal documents (wills, trusts, powers of attorney)
  • Provide legal, financial, tax, or medical advice
  • Guarantee the legal validity of any documents you upload or information you store
  • Replace attorneys, financial advisors, CPAs, or other licensed professionals

C. Price Floor

We will never discount below $79/year (early bird) or $49/year (promotional floor). This ensures sustainable operation and continued investment in security and features.

6. Your Content and Data

A. Ownership

You retain all ownership rights to the information, documents, media, and other content you upload to the Platform (“Your Content”). We claim no ownership over Your Content.

B. License to NOKP

By uploading Content, you grant us a limited, non-exclusive license to:

  • Store and encrypt Your Content on our infrastructure
  • Display Your Content to you and to family members you authorize
  • Process bill and medication photos through AI scanning (at your direction)
  • Back up Your Content for disaster recovery
  • Generate your 72-Hour Checklist and plan score from Your Content
  • Include Your Content in PDF exports you request
  • Deliver legacy messages you create to recipients you designate

This license terminates when you delete Your Content or close your account.

C. Your Responsibilities

You are solely responsible for:

  • The accuracy and completeness of information you enter
  • Ensuring you have the legal right to upload any documents or media
  • Determining who should have access to your plan and at what role level
  • Keeping your emergency contact information current
  • Maintaining copies of important original documents outside the Platform
  • Reviewing AI-extracted data for accuracy before saving

D. Prohibited Content

You may not upload:

  • Content that violates any applicable law or regulation
  • Content that infringes on others' intellectual property rights
  • Malware, viruses, or other harmful code
  • Content that violates others' privacy rights without their consent
  • Illegal materials of any kind

7. Family Sharing and Access Roles

You may invite family members or trusted individuals to view portions of your plan. The Platform supports three invited roles:

RoleAccess LevelCan Modify?
SpouseAll cards, medications, contacts, delivered legacy messagesCan add/edit cards and medications (not delete)
ExecutorAll cards, meds, contacts, secure notes, all legacy messages, full checklistRead + manage checklist; request elevated access; initiate account closure
Point PersonOnly shared/toggled cards, contacts, medications (read-only), delivered legacy messagesRead-only

You understand and agree that:

  • You control who has access and what they can see at all times
  • You can modify or revoke any role at any time
  • Family members you invite will receive an email invitation from us
  • Executor access to secure notes and full legacy messages requires access tier approval
  • We are not responsible for disputes between family members regarding access or content
  • Death-locked invitations remain pending until the appropriate access workflow is initiated
  • Account closure can be requested by an authorized executor through a documented process
  • A trusted approver you designate, or a funeral home submitting a verification we sent at your executor's request, can ask us to open the parts of your plan you set to open later. When that happens we email you first and wait approximately 24 hours before opening anything. You can stop it during that time using the link in that email. If you do not respond, access opens automatically. Where an access request is instead reviewed and approved by our support team on documentation, access is granted at the time of approval and you are notified then.

8. Professional Partner Access

If you access NOKP through a professional partner (estate attorney, financial advisor, employer, assisted living facility):

  • The professional partner does NOT have access to your vault contents unless you explicitly grant it within the Platform
  • Your relationship with the professional is separate from your relationship with NOKP
  • Partners see only aggregate, anonymized statistics (number of referrals, seat utilization)
  • We are not responsible for the professional's advice, services, or recommendations
  • Partner trial periods, seat allocations, and special pricing are governed by separate agreements between you, the partner, and NOKP

9. AI-Assisted Features

AI CONSENT: By using AI-assisted features — document and medication scanning, and generation of your 72-Hour Checklist and plan insights — you consent to having the relevant information processed by a third-party AI service (Anthropic Claude API) to extract structured data or generate guidance. Scanning uses photos you take; checklist and insight generation use plan details you have already saved (excluding account numbers, Social Security numbers, secure notes, and legacy message content). You may decline AI scanning and enter all information manually.

A. How AI Scanning Works

  • You take a photo of a bill, bank statement, or medication label using the Platform
  • iPhone HEIC photos are automatically converted to JPEG on our server before processing
  • The image is sent via encrypted HTTPS to the Anthropic Claude API
  • The AI extracts structured data (account name, number, provider, amounts, due dates, medication details)
  • The extracted data is returned to you with a confidence score
  • You review, correct if needed, and approve the data before it is saved to your account
  • The AI does not retain your images or data for model training (per Anthropic's commercial API terms)

B. AI Limitations

  • AI extraction and generated guidance may contain errors. You are responsible for reviewing all AI-extracted and AI-generated content before relying on it.
  • Low-confidence extractions are flagged for your manual review
  • AI never receives your account numbers, Social Security numbers, secure notes, or the contents of your legacy messages, and does not process audio or video legacy messages
  • AI is used only for document and medication scanning and for generating your 72-Hour Checklist and plan insights — for no other purpose

C. Your Right to Decline

AI-assisted scanning is entirely optional. You may manually enter all information into any form field without using the camera or AI features. No functionality is lost by declining AI scanning.

10. Legacy Messages

Paid subscribers can create legacy messages (text, audio recordings up to 30 seconds, and short video clips) intended for delivery to designated recipients.

You understand and agree that:

  • Legacy messages are stored encrypted on our servers until their scheduled delivery date or triggering event
  • Delivery is initiated automatically on the date/event you specify, or manually by an authorized executor
  • Once delivered, messages cannot be recalled
  • Audio and video recordings are stored as media files in private, encrypted storage buckets
  • We do not review, moderate, or screen legacy message content
  • You are solely responsible for the content of your legacy messages
  • Recipients receive legacy messages via the notification method you configure

11. No Professional Advice

Next of Kin Plan is a tool for organizing information. We do not provide legal, financial, tax, medical, or estate planning advice. We do not create legally binding documents. We do not guarantee that information stored in the Platform will be sufficient for any legal or financial process.

Always consult with licensed professionals for estate planning, financial planning, tax preparation, and medical directives. The information you store in NOKP is organizational, not legal.

12. Privacy and Security

We employ industry-standard security measures to protect your data, including:

  • AES-256-GCM encryption for sensitive data fields

  • Signed URLs with 10-minute expiry for document access
  • Private storage buckets with no public file URLs
  • Rate limiting on authentication endpoints
  • Comprehensive security headers (CSP, HSTS, X-Frame-Options: DENY)

For complete details, refer to our Privacy Policy.
